Terms and Conditions

Welcome to Charter Buddy. These Terms and Conditions ("Terms") govern your access to and use of the Charter Buddy website, mobile applications, APIs, and related services (collectively, the "Platform"). The Platform is operated by Point Overlook Ventures LLC, a Pennsylvania limited liability company. By accessing or using the Platform you agree to these Terms. If you do not agree, do not use the Platform.

Platform role. Charter Buddy is an invite-only digital bulletin board and marketplace that enables Captains and Anglers to find one another, view profiles, and schedule trips. We are a technology provider, not a maritime operator.

No vetting or guarantees. Charter Buddy does not operate, manage, perform, or supervise charter services. We do not verify Captains' Coast Guard licenses, insurance policies, safety records, or background checks. The inclusion of a Captain on the Platform—whether invited directly by a Charter Buddy administrator or through our peer-to-peer referral system—is strictly for the purpose of building the marketplace network and does not constitute vetting, an endorsement, or a guarantee of safety by Charter Buddy.

Algorithmic Sorting. Any labels such as 'Trending,' 'Community Favorite,' 'Top Rated,' or 'Featured' are generated by automated algorithms based on platform activity, availability, and user reviews. These labels do not constitute an endorsement, safety certification, or guarantee of quality by Charter Buddy.

User acknowledgement. You acknowledge and agree that Charter Buddy is not responsible for the conduct of any user, and that all transactions and fishing activities are solely between the Captain and the Angler.

Captain subscriptions. Captains must maintain an active subscription to be listed on the Platform. Fees are for software access only, not for lead generation commissions. Subscription fees are non‑refundable.

Invitations and 'Locked' State. Captains may only create an account using a unique invite code provided by an existing member. Upon registration, new accounts are in a 'locked' state and are hidden from Angler search results until a subscription is paid and activated. If a subscription is not activated, the user may release the invite code back to the referrer.

Referral Discounts and Loyalty. Captains who refer a new user may earn a discounted subscription rate. This discount is strictly contingent upon the referred user maintaining an active, paid subscription. If the referred user cancels, deletes their account, or is suspended or banned from the Platform for violating these Terms, the referrer will lose their discount after a 30-day grace period and revert to the standard subscription rate. Additionally, if you cancel your own subscription, you forfeit your referral discount and your invite code.

Angler access. Anglers may use the Platform free of charge to find charters. Charter Buddy does not charge Anglers a booking fee.

Account responsibility. You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account.

Prohibited conduct. You must not, directly or indirectly:

• Use the Platform for unlawful purposes or in violation of these Terms.

• Share, sell, or manipulate single-use invite codes, or abuse the referral discount system.

• Misrepresent your identity, qualifications, licensure, or insurance status.

• Post content that is abusive, harassing, defamatory, fraudulent, or otherwise objectionable.

• Engage in no‑shows, scams, or any attempt to defraud other users.

• Use the Platform to facilitate commercial resale of services without our prior written permission.

Anti‑scraping. You may not access, copy, scrape, harvest, or index data from the Platform by automated means (bots, spiders, scrapers) without our prior written permission.

Communication Consent. By creating an account, you consent to receive communications from us and from other users regarding your bookings, including via email and SMS text messages. Standard message rates may apply.

Monitoring. We may monitor access to the Platform to detect abuse and protect users, but we have no obligation to monitor user content or disputes.

Enforcement actions. Violations of these Terms may result in immediate suspension or termination of accounts without refund of subscription fees.

Remedies. We may seek injunctive relief, damages, and recovery of costs and attorneys' fees for violations of these Terms.

Charter locations. Charters arranged through the Platform may take place in any jurisdiction within the United States.

Captain Responsibility. Captains are solely responsible for knowing and complying with all federal (USCG), state, and local laws, including licensure, permitting, and insurance requirements for the specific waters they operate in.

No Platform oversight. Charter Buddy does not monitor or enforce local compliance. The Captain bears full liability for the legality of their operation.

Prohibited Behavior. We have a zero-tolerance policy for fraud, harassment, discrimination, or unsafe conduct. If a user is reported for such behavior, we reserve the right to ban them immediately and permanently.

Reporting. Users should report suspected abuse to contact@mycharterbuddy.com. While we will investigate reports, Charter Buddy is not an arbiter of facts and is not liable for the outcome of any interaction between users.

INHERENT RISKS. ANGLERS ACKNOWLEDGE THAT FISHING, BOATING, AND MARINE ACTIVITIES INVOLVE INHERENT RISKS, INCLUDING BUT NOT LIMITED TO DROWNING, SLIPPING, FALLING, HOOK INJURIES, WEATHER HAZARDS, AND EQUIPMENT FAILURE. ANGLERS VOLUNTARILY ASSUME ALL RISKS ASSOCIATED WITH PARTICIPATING IN CHARTERS ARRANGED THROUGH THE PLATFORM.

NO LIABILITY. CHARTER BUDDY SHALL NOT BE LIABLE FOR ANY INJURY, DEATH, PROPERTY DAMAGE, OR LOSS ARISING FROM A CHARTER TRIP. THE CAPTAIN IS SOLELY RESPONSIBLE FOR THE SAFETY AND OPERATION OF THE VESSEL.

Accuracy requirement. Captains warrant that their profile information—including boat details, amenities, and credentials—is truthful and accurate.

User-Vetted Marketplace. Charter Buddy provides transparency, not verification. It is the Angler's sole responsibility to ask to see the Captain's Coast Guard License and Insurance Certificate before boarding the vessel.

No endorsement. Reviews, ratings, and 'Featured' statuses are user-generated or data-driven and are not guarantees of quality or safety.

Direct Payments Only. Charter Buddy does not process, collect, or hold funds for charter trips. All deposits, balances, and tips are transacted directly between the Angler and the Captain (e.g., via Cash, Venmo, Square, or Credit Card terminal).

No Refund Capability. Because Charter Buddy never holds the trip funds, we are technically unable to issue refunds for charter trips. All requests for refunds must be directed to the Captain.

Cancellation Policies. Captains set their own cancellation policies. Anglers are responsible for reading and understanding these policies before booking.

Platform IP. All Platform content, branding, and software are owned by Point Overlook Ventures LLC.

User content. You retain ownership of content you post (photos, reviews) but grant Charter Buddy a license to use that content to operate and promote the Platform.

Disclaimer. The Platform is provided "as is." We disclaim all warranties, express or implied.

Limitation of Liability. To the maximum extent permitted by law, Point Overlook Ventures LLC is not liable for any indirect, incidental, or consequential damages, or for any injury or loss arising from your use of the Platform or participation in a charter.

Cap on Liability. Our aggregate liability for direct damages will not exceed the total subscription fees paid by you in the six months preceding the claim or one hundred dollars ($100), whichever is greater.

You agree to indemnify, defend, and hold harmless Point Overlook Ventures LLC from any claims, liabilities, damages, and expenses (including attorneys' fees) arising from your use of the Platform, your breach of these Terms, or any injury or damage occurring during a charter trip you booked or operated.

Informal resolution. You agree to attempt to resolve disputes informally by contacting us first.

Binding Arbitration. Any dispute between you and Charter Buddy shall be resolved by binding arbitration in Chester County, Pennsylvania.

Class Action Waiver. You waive the right to participate in a class action lawsuit or class arbitration against Charter Buddy.

User Disputes. Charter Buddy is not a party to disputes between Anglers and Captains. You release Charter Buddy from all claims, demands, and damages arising out of disputes with other users.

These Terms are governed by the laws of the Commonwealth of Pennsylvania. Any court actions not subject to arbitration must be brought in Chester County, Pennsylvania.

Our collection and use of personal information is governed by our Privacy Policy. By using the Platform, you consent to the data practices described therein.

We may modify these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the revised Terms.
